Section 4(a) of Presidential Decree No. 449 defines cockfighting as the commonly known game or term cockfighting derby, pintakasi or tupada, or its equivalent terms in different Philippine localities. The table lays out the terms.

A tupada is therefore not a different offence or a separate sport: the law names it as one of several words for cockfighting.
Tupada versus a licensed cockpit derby
The distinction the law draws is about where and when, not about the name. Section 5(d) says cockfighting is allowed only in licensed cockpits, on Sundays, legal holidays and local fiestas for not more than three days, with listed days excluded.
- A tupada in a licensed cockpit on an allowed day is lawful.
- The same tupada in an unlicensed place is not; the order recites that the decree prohibits cockfights in unlicensed cockpits.
- Gambling of any other kind on the premises is barred by Section 5(f).

Where a tupada stops being lawful
Three things take a tupada outside the decree: no licence, a day outside Section 5(d), or any other gambling on the premises. Section 8 sets prision correccional and fines for violations.
